Twisty Bar School Refund Policy:
After registering, students may get a refund within 24 hours of an educational course purchase. There are no fees if a refund is requested within 24 hours as long as course materials have not yet been shipped out. If course materials have already been shipped out to the student before their refund request, then the student must return the course materials sealed and unopened within 7 days of receiving them in order for a refund to be processed. Return shipping costs must be paid for by the refund requesting student and there is a $35 materials handling fee accessed (which is deducted from the full refund amount). After 24 hours of a purchase there are no refunds given for any reason. If a returned package arrives to our company unsealed, opened, or damaged in any way then no refund will be issued. No refunds are issued for any reason once any course videos have been accessed or any course materials have been opened or used. For all products aside from educational courses (such as trucker hats or additional tools), there are no refunds issued once a purchase is made as many of these orders are printed or constructed on demand (sometimes by 3rd parties). There are no refunds issued for physical merchandise and all sales are final (unless a product is defective, in which case it may be exchanged for a replacement). This is our standard refund policy, but legal compliance adjustments may be enacted in certain jurisdictions where enforceable, dependent on local regulations and applicable laws. Twisty Bar School Privacy Policy:
Data collected from our students and customers (such as information collected upon registration or information obtained while students are enrolled in our course) is used exclusively for our company’s purposes, and unless required by law we do not sell, share, or otherwise distribute our student’s data or customer’s data to any entity outside of our organization for any reasons unrelated to our company’s activities or purposes. We take privacy issues extremely seriously and have no intent whatsoever to store, share, or use data in any way that is not conducive to our operations. We intend to offer the best services that we can and to enhance our customer’s experience in the best ways possible with always keeping the importance of privacy in mind. This is our standard privacy policy, but legal compliance adjustments may be enacted in certain jurisdictions where enforceable, dependent on local regulations and applicable laws. Thanks for your interest in our courses! Below are our terms of service along with some company policies about the program. The purchaser or user of this service hereby agrees to all terms of service listed within this document. Laws vary by region and all laws must be complied with in any location where a class is taken or course information is applied. All terms of service listed here are subject to be updated or altered at any time, with the most recent version being binding. Section 1. How the Class Works, Key Terms and Definitions, Company Communications, and Changes to Our Services:
When a student registers for a course we ship them a Twisty Kit (bartender tool kit) along with a Student Manual. This package also contains a sheet with instructions about how to access the course videos on our learning platform. Once the package is received the student can begin the online course videos. After successfully completing the videos on the student’s own time, they can then join an interactive mixing session with an instructor to practice pouring methods and cocktail mixing techniques. Once this interactive mixing part of the class is completed (and the student has shown satisfactory proficiency) we send the student the TIPS alcohol safety course. Upon finishing the full program (including the bartending course and TIPS alcohol safety course) we issue the student a Bartender Certificate Card that shows they have successfully completed training from our school. At this point they are given access to the Twisty Bar Crew job platform where they can create a user profile in order to showcase their skills to bars and freelance event clients. We also offer our graduates who join the Twisty Bar Crew access to other bartender necessities such as the ability to purchase additional bartender tools, basic assistance with legal forms (such as showing which paperwork may generally be needed to become a self-employed private contractor), and the opportunity to purchase alcohol liability insurance, which can be used for freelance bartending events. In these terms of service there are some words that may need clarification when not obvious in context. The word “user” refers to anyone who is using the Twisty Bar School service (and it refers to a user of the Twisty Bar Crew platform when shown in the Bartending Work and the Twisty Bar Crew Job Platform section of this agreement). The word “school” refers to Twisty Bar School, unless stated otherwise. The word “student” refers to a past or present student who has been enrolled in the Twisty Bar School program, unless stated otherwise. The word “graduate” refers to a person who has completed the Twisty Bar School program, unless stated otherwise. The words "course" and "class" and "program" refer to the Twisty Bar School educational program (and the word "program" also includes the Twisty Bar Crew platform in the Bartending Work and the Twisty Bar Crew Job Platform section of this agreement. The word “company” refers to Twisty Bar School and this includes Twisty Bar Crew in the Bartending Work and the Twisty Bar Crew Job Platform section of this agreement. At Twisty Bar School we try our best to provide the most informative and all-encompassing educational experience possible, and we reserve the right to make important changes to our program when necessary. Our school may add or remove any service offerings, or change any of the services or products that we offer at any time without prior notice. We may add or remove any of our services or products without the approval or permission of others, and without any sort of reimbursement (monetarily or otherwise) to anyone who may be affected by this. In the case where an expected part of our service is removed or altered, then we will do our best to compensate the customer with an alternative service of comparable value (although this may not always be possible in all instances). Any part of our program or service offerings may be modified at any time for any reason solely based on the discretion of our company. Additionally, any of our promotions or deals or bonuses or discounts are subject to change and each may have its own set of separate terms. Upon registering for a course, our school may send messages, notices, and updates to the email address provided by the registrant. This may include important class details, messages containing documents or student login instructions, testing or interactive mixing session information, periodic communications about school happenings, student offers, partner or affiliate information, industry updates, or other company related material. At any time you may easily opt out of further communications or unsubscribe from our periodic newsletters if contact is no longer necessary or desired. If there is a missed email message by the receiver, that was properly sent by the sender, or if a student’s registered email address becomes invalid, then the school is not responsible for any missed communications. As we go forth we intend to offer excellent bartender services to our graduates, and hope to add even more features to our programs while we continue to provide our students with the best bartending education possible. Section 2. Limitation of Liability, Warranty Disclaimer, and Warranty Waivers:
At Twisty Bar School we strive to provide the most informative and all-encompassing bartending education that we can while emphasizing responsible alcohol serving methods throughout our courses. We teach traditional cocktail recipes that are standard throughout the industry, but if a cocktail recipe’s ingredients contain more alcohol than is legally allowed to be served in a certain location, then those ingredients must be adjusted to adhere to local rules. Laws vary by region so it’s very important that people fully understand the laws and regulations in their own area when working with alcohol or handling alcohol in any way. We strongly encourage anyone who is handling alcohol to follow all laws in their local jurisdiction. Please be aware that the legal age to bartend or handle alcohol varies by state (which is usually set between 18 years of age to 21 years of age) and all current and former students must comply with all applicable laws. The information taught in our program is for educational purposes only and is not intended to be used as legal, medical, financial, or other consequential or professional advice. Twisty Bar School is in no way responsible for the actions of individuals who may not follow local laws, or who do not comply with responsible alcohol safety practices, or who misuse alcohol related knowledge outside of our class. We offer alcohol safety training so that our students can become aware of responsible alcohol serving techniques, yet no person from our company is in any way responsible or liable for the actions of anyone who has learned from our courses, or who has learned from any of our affiliated alcohol safety training programs. If a current or former student does not apply proper safety methods while handling alcohol, then the responsibility for their actions lies on themselves and not on their educational provider.
PLEASE BE ADVISED THAT OUR CLASSES ARE OFFERED ON AN “AS IS”, “WITH ALL FAULTS”, AND “AS AVAILABLE” BASIS. ALL OF OUR CLASSES AND EDUCATIONAL OFFERINGS ARE TAKEN SOLEY AT THE STUDENT’S OWN RISK. Twisty Bar School and its affiliates, to the full extent permitted by law, grants no warrantees of any kind, whether express, implied, statutory, or otherwise with respect to our services (including the implied warranties of merchantability, performance quality, or fitness for a particular purpose). While we strive to provide an extremely accurate and highly beneficial educational experience, there is no guarantee that our services, materials, or content will be 100% accurate, reliable, error-free, correct, safe, secure, available, or lead to intended or specific outcomes in all cases. Our school tries our absolute best to make our teachings and guidance as excellent as possible, but there are still chances for mistakes to be made. Twisty Bar School does not guarantee any specific results, monetary or income gain, employment or work opportunities, financial or business success, improvement of knowledge, gain in professional ability or skills, quality of competency, or any other desired outcome or improved outcome from taking our courses. Our company cannot be held liable for failure of service, providing wrong or harmful information, or any consequential results that arise from joining our courses. To the extent permitted by law, the maximum aggregate liability of Twisty Bar School and its affiliates, for all damages, losses, and causes of action, whether in tort (including negligence), contract, or otherwise, shall not exceed the amounts paid to the school by the customer (prior to any claim) for educational courses taken or services rendered within the last 12 months (including any other payments made for other goods or services such as additional tools). If you are dissatisfied with our service in any way, your sole remedy is to discontinue using it. The school may change class offerings without penalty to the school or compensation or reimbursement to anyone affected (monetary or otherwise). All students enrolling in the program hereby waive all rights to claims of damages or harm from the school changing course materials or class offerings. All descriptions of bartending equipment issued to students in our bartender tool kits (“Twisty Kits”) are approximations and as we do our best to accurately describe the tools students receive as part of our program, the equipment involved is subject to change and items may be added or removed or modified based on the sole discretion of the school as well as item availability. If a student misses any part of a class due to a reason that is beyond our reasonable control or not at the fault of our school (such as a poor internet connection, an electrical outage, a malfunctioning computer or technological problem, inclement weather, societal instability, a natural or unnatural emergency, a medical issue, government restrictions, an unexpected or undesired event, or any other type of issue) then the school is not responsible or liable for that situation in any way and will not issue any sort of refund or compensation in any way for the circumstance. However, in such cases (and if deemed possible by our administrators) the school will attempt to take appropriate steps to help any affected students by doing things like rescheduling a cancelled class, or by helping affected students with making up missed material so they can still receive the best educational experience possible and not miss out on learning the course information.
While we heavily stress alcohol safety and responsibility throughout our program, our company’s workers, employees, instructors, owners, managers, contractors, partners, guest speakers, members, directors, representatives, agents, officers, associates, licensors, suppliers, or any other entities affiliated with our company, are in no way responsible or liable for any current or former student’s actions, or conduct, or mistakes, or ramifications outside of our courses. Individuals are responsible for their own decisions and actions regardless of our company’s strong emphasis on safety. Furthermore, our class is generally safe to attend, but if a student experiences some soft of unexpected accident, or injury, or harm while taking our course, or at any time afterwards (pertaining to or related to the class information taught), then our company, along with its workers, owners, associates, representatives, and affiliates, are not responsible for such situations or consequences, and we collectively release all liability for any harm caused by any sort of occurrences. This statement applies to various situations such as a current or former student cutting themselves with a knife while slicing garnishes, or accidentally breaking glassware, or spilling mixer liquid, or slipping on a wet surface, or dangerously serving too much liquor to a guest, or practicing unwise or unsafe alcohol handling methods, or bartending in an unsafe or dangerous manner (illegally or not), or not practicing proper alcohol safety protocols, or not following rules or guidelines, or not being responsible with alcohol service, or not practicing proper work ethics or safety procedures, or not conducting themselves properly, or any other action (unintended or otherwise) that may cause displeasure or danger or harm in any way (including any direct or indirect consequences) that may arise from such behaviors or actions. WE STRONGLY ENCOURAGE ALL BARTENDERS TO ALWAYS BE SAFE AND RESPONSIBLE AND TO FOLLOW ALL APPLICABLE LAWS WHILE SERVING GUESTS OR HANDLING ALCOHOL. SAFETY AND RESPONSIBILITY ARE ESSENTIAL WHEN WORKING WITH ALCOHOL IN ANY WAY. We highly recommend all students to practice responsible mixology techniques and to be as safe as possible while in attendance of our class and at any time afterwards. Yet there is still no guarantee that a harmful situation may not occur. Instances like these may be relatively rare, but it is important for all students to acknowledge that they are taking this bartending class, along with any affiliated alcohol safety training program, exclusively at their own risk. By agreeing to our terms of service, all students fully acknowledge these conditions. Anyone who participates in our classes, or purchases our services or products, releases our company and its workers, owners, associates, representatives, and affiliates from all claims of any harm, liability, suffering, damages, judgements, awards, expenses (including reasonable attorneys’ fees), costs, losses, and compensation arising from having taken or experienced our program in part or in whole. There is no guarantee that the educational training that we teach, or that our affiliates provide, can completely prevent intoxication and its potentially dangerous consequences. Twisty Bar School hereby disclaims any and all responsibility or liability (direct or indirect) for any incidental, consequential, special, exemplary, or punitive practices, policies, alcohol related situations, loss of business, loss of savings, loss of profit, loss of revenue, personal harm or injury or suffering, commercial damages, technological damages to devices or loss of data, or any other sort of harm or distress of any individual or entity or establishment subsequent to such individuals or entities or establishments having been trained or educated in any way from our programs. Our company is not in any way responsible for any unintended harm that may arise from a student learning from our courses. By agreeing to these terms of service the purchaser or user waives all claims to compensation for any harm or difficulties experienced after having taken our educational program in part or in whole in any way.
Section 3. Disclaimer for Class Participants who Bartend or Handle Alcohol:
OUR COMPANY DISCLAIMS ALL LIABILITY OR HARM OR LOSSES FOR ACTIONS TAKING BY YOU OUTSIDE OF OUR COURSES. TWISTY BAR SCHOOL IS NOT RESPONSIBLE IN ANY WAY FOR THE ACTIONS INDIVIDUALS TAKE OR MISTAKES INDIVIDUALS MAKE, AND ANY HARM OR LOSS THAT MAY ARISE FROM SUCH ACTIONS OR MISTAKES. YOU AGREE THAT YOU ALONE ARE RESPONSIBLE FOR YOUR OWN CONDUCT AND ANY AND ALL CONSEQUENCES THEREOF. HANDLING ALCOHOL CAN BE DANGEROUS AND INVOLVE UNSAFE SITUATIONS, SO WE STRONGLY URGE PEOPLE TO BE AS CAREFUL AS POSSIBLE WHILE BARTENDING OR WORKING WITH ALCOHOL IN ANY CAPACITY. While Twisty Bar School attempts to teach about cocktails and alcohol-related issues in the safest and most responsible manner possible (including offering our students in-depth alcohol safety training from industry-leading providers), our company cannot be held responsible or liable for the individual actions or decisions of people who have participated in our program. There is no guarantee that our bartending courses, or the alcohol safety training that we provide or that our affiliates provide, can effectively prevent alcohol intoxication or any dangerous situations that may cause harm or damages or unwanted affects. Throughout our course, our company heavily stresses the importance of safe alcohol serving, but we cannot control the actions or decisions of individuals either while they are taking our course or after they are no longer enrolled in it. If a dangerous or harmful situation occurs from a currently enrolled student or from a previously enrolled student, then our company and affiliates cannot be held responsible or liable in any way for that current or former student’s actions, mistakes, or behavior. Laws and safety rules vary by region and they must be fully complied with by individuals who are involved with bartending or handling alcohol in any way. We also try our very best to teach the most effective bartending techniques possible, but if a person feels as if our school may have taught them something negatively impactful in any way, then they agree to forfeit any and all claims to any soft of retributions or compensation (monetarily or otherwise) and their only remedy is to stop using our services. By agreeing to these terms of service, students fully waive and release all claims against our company and its workers, owners, associates, representatives, and affiliates for any harm or liability arising in part or in whole from the programs we offer or educational material that we teach.
Section 4. Endorsements for External Products or Services:
Unless noted otherwise, our company does not endorse or affiliate itself with any brands or other companies mentioned during classes or outside of class on social media, while attending events, or during any other activity the school may be involved with. Our company is also not responsible for any external content that a representative from our school may mention, recommend, or discuss, nor are we responsible for any external content that may be mentioned or displayed by our company at any time in any way. Twisty Bar School does not endorse, promote, support, or recommend any product or service unless we explicitly claim to be doing so.
Section 5. Intellectual Property, Copyright Information, and the Unauthorized Use or Sharing of Course Materials:
Our courses are intended for individual use by a single purchaser. No other person is allowed to view, listen to, read, learn from, or experience the course materials in any way aside from the singular individual who purchases their own educational course from our school (or for a singular individual that a course is purchased for). No part of any of our video courses or interactive courses, written materials, teaching or operational methods, logos or trademarks, proprietary techniques, or any other aspect of our program may be shared, distributed, streamed, recorded, shown to others, copied, modified or edited, republished, sold or licensed, rented, lended, exploited, or reproduced in any manner whatsoever without notarized written consent from the owner of our company. No course video clips, copied text or images, student manual pages or information, platform login or password details, test questions or answers, course screenshots or photos or recordings, teaching or operational methods, or any other aspect of our program may be downloaded, stored, displayed, posted on social media sites, uploaded to video streaming sites or audio streaming sites or internet websites, uploaded or shared to public platforms or forums, emailed or otherwise messaged to others, transferred or transmitted digitally or physically to others, shown to others either privately or publicly, performed publicly, or broadcasted in any way whatsoever without notarized written permission from the owner of our company. All students agree not to misrepresent or falsely portray our school or course offerings after having taken our program or used our company’s services. If a customer has a complaint or problem with our school then we request that this issue be brought to the attention of our company so we can attempt to fix the situation and compensate for a loss, before responsive actions are taken (such as an unwarranted negative review that does not take into account the company’s efforts to remedy the situation). We welcome constructive feedback and hope to resolve all concerns before posting public grievances.
NO PART OF OUR PROGRAM MAY BE USED TO CREATE ANY SORT OF DERIVATIVE WORK FOR PERSONAL, COMMERCIAL, ARTISTIC, OR OTHER USES THAT MAY INFRINGE UPON OUR SCHOOL’S INTELLECTUAL PROPERTY. By agreeing to these terms you accept all of these conditions and agree not to use any of our classes or materials to create similar works or derivative works, or to offer any sort of similar courses (online, in-person, or otherwise), or to compete with our school in any sort of meaningful manner within any of the areas where our company operates. Engaging in competitive activities in breach of these terms may result in leaving the perpetrators legally vulnerable and subject to significant monetary damages including (but not limited to) disgorgement of profits and compensation for any business losses suffered by our company. No part of our program or intellectual property may be used without notarized written consent from the owner of our company. In any case of written consent being given, this written consent must be signed and legally notarized by all agreeing parties. If our school’s intellectual property or copyrighted material seem to have been exploited, misused, or violated in any way, then the school reserves all rights to vigorously pursue legal action through extended lawsuits or other means necessary to the fullest extent of the law. Copyright issues must be taken extremely seriously so we highly recommend that anyone involved respect the strong legal protections granted by state, federal, local, and international legislation. It is simply best not to share or showcase any unauthorized material at any time to anyone aside from the singular individual who has purchased a course. By agreeing to these terms of service the purchaser understands that they may be held legally liable for substantial damages if they share, record, reproduce, show, or distribute course material in any way without explicit written and notarized permission from the owner of our company. This includes creating any sort of derivative or similar work based on our intellectual property. These civil damages may be extensive and there could be severe criminal punishment along with substantial monetary compensation for losses the company could endure due to such proprietary course materials being improperly used. Anyone who misuses our company’s intellectual property will be prosecuted in a court of law. You agree to keep all information about the company’s internal operations, trade secrets, proprietary methods, business strategies, and other commercially useful knowledge strictly confidential and will not share any information with anyone in any way. All student manual text and images, school educational information, video recordings, artwork, trademarks, logos, operational methods, online content, and all other applicable company materials and program information are legally protected intellectual property of Twisty Bar School. All rights reserved.
Section 6. Disputes, Class Liability Disclaimers, Governing Law Jurisdiction, Arbitration, Indemnity, Mandatory Pre-Arbitration Dispute Resolution, and Notification of Legal Action:
Twisty Bar School is committed to using our best efforts to resolve disputes with our users without the need of a formal legal claim to be sought after or filed. If a dispute or contested issue arises between us, you and our company agree to diligently try to reach a fair resolution that is acceptable to both sides using a mandatory informal dispute resolution process described herein, which may include arbitration if a dispute is not adequately settled prior to that point. If you bring a legal action, claim, cause of action, or dispute against our company for any reason and do not prevail or do not achieve the relief requested, then you agree to fully reimburse the company and its representatives for all reasonable attorneys’ fees and for all costs incurred for our company’s defense. This reimbursement must be carried out and paid immediately after the legal case is decided. You agree to indemnify and hold harmless Twisty Bar School and all of its representatives, relevant associates, relevant affiliates, directors, agents, owners, managers, workers or employees, representatives, along with all other parties related to our company who are involved in legal cases, from any claims, demands, damages, harm, liabilities, losses, expenses (including all reasonable attorneys’ fees) arising out of or in connection with any claim or action or dispute. This includes your use of our services or goods, or your violation of any of these terms, or your improper use of our platforms or services, or your breach of these terms (including any supplemental terms that apply to individual products or features or services), or your participation in any of our services. This covers, without limitation, any losses or damages (whether compensatory, direct, indirect, incidental, consequential, or otherwise) of any kind arising with or as a result of such participation in a service, or your breach of any laws or regulations or rights. Any claim must be brought within one calendar year of the incident. No action or claim, regardless of form, that arises out of this agreement or relating to this agreement may be brought forth by either party more than one calendar year after the cause of action has occurred, except where this expediency limitation cannot be imposed by law (in which case the shortest length of time legal allowed for a claim to be brought forth shall take precedent). You and our company agree that any dispute that arises will be resolved on an individual basis and not as part of any class, consolidated, or representative action. You and our company agree that you and we will only be permitted to bring forth claims against the other on an individual basis and not as a class member or plaintiff in any representative action or proceeding or in any purported class. By agreeing to these terms you waive any right to participate in a class action or mass filing against the company or its officers, directors, employees, agents, owners, affiliates or representatives. EXCEPT FOR CASES CONCERNING INTELLECTUAL PROPERTY ISSUES, OR COPYRIGHT INFRINGEMENT MATTERS, OR THE MISAPPROPRIATION OF TRADE SECRETS OR THE MISAPPROPRIATION OF CONFIDENTIAL INFORMATION, OR VIOLATIONS OF OUR NON-COMPETE CLAUSE, OR IN SITUATIONS CALLING FOR EMERGENCY INJUNCTIVE RELIEF, YOU AND TWISTY BAR SCHOOL HEREBY WAIVE ANY RIGHT TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY. YOU WILL ONLY BE PERMITTED TO PURSUE DISPUTES AGAINST EACH OTHER, OR OTHER USERS OF OUR SERVICE, THROUGH BINDING AND FINAL ARBITRATION. ONLY INDIVIDUAL RELIEF IS AVAILABLE. In certain cases our company may agree to have disputes resolved in small claims court rather than arbitration, but this is dependent on the conditions of the dispute. Unless you and our company both mutually agree otherwise, the arbitrator may not join or consolidate more than one person’s or party’s claims and may not preside over any form of a representative, consolidated, or class proceeding. The arbitrator may award relief (including injunctive, declaratory, and monetary) only in favor of the individual party seeking such relief and only to the extent necessary to provide such relief required by that party’s own individual claim or claims. Any relief rewarded in any way cannot affect any other customers, users, or participants. To reemphasize, you agree that any dispute or claim arising from our services or relating to our services will be resolved exclusively through binding arbitration chosen by our company, and you waive any right to bring forth any class action case or pursue disputes in a court of law or have a trial by jury. You and Twisty Bar School, and anyone representing either of us, acknowledge and agree that, to the fullest extent that is permitted by law, each of us is waiving our right to participate as a class member or plaintiff in any purported class action lawsuit, private attorney general action, class arbitration, or any other representative or collective or consolidated preceding. This includes disputes between students (or customers) and our school, between bartenders and clients, or any other type of matter or dispute. The school will select a single neutral arbitrator, and the arbitration shall take place in the state where our company is based, or if the school decides that is not an appropriate location then it may be moved to a in a mutually agreed jurisdiction. Any ruling by a chosen arbitrator is not subject to further appeal or recourse, and the final arbitration decision is binding with all such matters resolved. At least 30 days prior to a party initiating an arbitration, you and our company each agree to send the other party a written notice of the dispute (“Pre-Dispute Notice”) and attempt in good faith to negotiate an informal resolution of the claim. You and anyone acting on your behalf, agree that this informal resolution is to be sought after prior to any formal arbitration or other legal action. If you are bringing a dispute, you must email our company at mix@twistybarschool.com to request the mailing address where this notice should be sent. You agree that you will confirm that the email was received by requiring an official response from our company, and in a case where the email is missed and there is no response given, then you must continue to try to reach us until there is a confirmed acknowledgment that the dispute notice message was received. A pre-dispute notice must include your full name, the date, mailing address, username, email address used for your account, phone number, signature, a description of the dispute, and the relief sought. If the parties are not able to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written demand for arbitration with the designated arbitration provider. A claimant’s pre-dispute notice requirement is a mandatory prerequisite to any arbitration, and a copy of the pre-dispute notice, along with evidence that it was sent and received as required by this section of terms, must be attached to any arbitration demand. All mailed notices must be sent by registered or certified mail with return receipt requested and proof of correspondence being received. Any claim shall be limited to the total amount paid for the products of services provided, as our liability is limited to that monetary amount.
Section 7. Following Class Rules and Student Participation Information:
All student device video cameras and audio microphones must be functioning and turned on at all times while attending our school’s interactive online mixing sessions. Students must be able to be clearly seen and heard by the instructor throughout the lessons so that the instructor can guide them with practicing mixing and assess how they are performing. Also, all students must have all of the course materials and mixing ingredients (such as the student manual, bartending tools, a pen, ice, water, mixers, garnishes, and other required materials and ingredients) present, organized, and ready to use in order to participate in a mixing session. If a student does not have some of the required course materials or mixing ingredients available, then they may be prevented from attending the interactive mixing session. Students must be on time to any scheduled educational session or school event and not doing so may result in them not be admitted. If a student is disrupting or disturbing the class, being inattentive, being disrespectful to others, showing up intoxicated, not wearing acceptable attire, not presenting themselves professionally, or attending the class from a distracting environment, or behaving inappropriately or unacceptably in any way, then we reserve the right to refuse them admission. If a student needs to be removed from a class then they will not be offered a refund in any way (unless the school deems a refund to be appropriate), and they will also not be compensated (monetarily or otherwise) for any missed time or missed educational material. All interactive mixing sessions and in-person training shifts are subject to availability and may be postponed, rescheduled, or cancelled for any reason at any time at the sole discretion of the school without any sort of compensation or reimbursement to anyone who may be affected by such a change. Students are not allowed to post rude, distasteful, obnoxious, negative, offensive, educationally disruptive, disrespectful, or otherwise inappropriate comments in the course video forums or on any school communication chat forums, and doing so may result in the student being penalized or removed from our program with no compensation or refund. All students who enroll in the class agree that their own activities, and expressions, and communications (such as written or spoken comments, posts, messages, discussions, reviews, or any other transmissions or correspondences) are monitored and may be used by the school for promotional purposes or other commercial purposes, research purposes, or quality control reasons. All students who join the class consent to being recorded both visually and audibly, and hereby grant permission for their image or likeness to be used by the school for promotional or commercial purposes or any other company related reasons (unless explicitly requested otherwise in a written and notarized letter received by the school). All students agree to conduct themselves in a manner appropriate to our school’s standards and agree to represent our company in a positive manner while in attendance of our educational courses or company programs.
Section 8. Shipping Issues:
If a package sent by our company (such as one containing a student manual, bartender tool kit, bartender certificate card, or anything else) is shown to be delivered at the designated address by the shipping service, but that package is not received by the purchaser due to it being intercepted or somehow lost or misplaced for any reason, then our company is not responsible for the affected items or for the cost of replacing or reshipping any unreceived materials. With that outlined, our company will handle situations like this on a case by case basis, and we will do our best to help remedy the situation however we can. This may include helping with filing lost package claims or reshipping a package in some circumstances. Please be sure to use accurate address information (such as correct formatting, delivery instructions, and the inclusion of all necessary building unit numbers) while registering to avoid any unexpected mishaps concerning shipped packages.
Section 9. Student Requirements, Eligibility, Program Approval, Account Validity, and Refusal of Service:
Twisty Bar School has some requirements for students who purchase our services or participate in our courses. We require that all students be at least 18 years of age at the time of them starting the course. This is because the legal age to bartend in many locations is 18 and we feel that this is an appropriate age to learn about the profession. If a student takes the class at an age between 18 to 21, but they are not permitted to bartend until 21 in their state or local area, then they must wait until they are the legal age to serve alcohol before they may use their educational skills to bartend. Students must have a technologically capable device (such as a computer, smartphone, or tablet) with a sufficient and reliable internet connection in order to watch online class videos and join the interactive mixing session with a live instructor. During interactive mixing sessions students must also have their device’s video camera on at all times so that the instructor can clearly see and hear them in order to evaluate their performance. Students are required to have mixing ingredients (such as sufficient amounts of ice, water, juices, sodas, margarita salt, fruits, sour mix, and other ingredients) in order to participate in any interactive mixing sessions. These ingredients generally cost under $30 to purchase, but may cost more depending on brands bought and the local price of each individual product. Students who register for this class agree that they are able and willing to purchase any required ingredients for the interactive mixing session, and that they have access to a sink with running water throughout any interactive mixing session, and that they also have a flat surface (such as a table or counter) to utilize for mixing drinks along with the instructor. Any other course video requirements and interactive mixing session requirements listed on our website or in school notices or in instructional forms must also be met in order for students to participate in our programs. All students must be well-mannered and respectful to all representatives and affiliates of our school along with all other students at all times as well. All data, wifi, and other relevant expenses must be paid for by the student while engaging in our services over the internet. All students must represent themselves accurately with their correct names and government-issued personal identification information when registering and at all times during our program or when submitting information to our school. Misrepresenting oneself is a breach of these terms and may result in immediate expulsion from classes, revocation of school credentials, and other substantial repercussions (including potential legal actions resulting from such violations). Students are not allowed to take the class on behalf of someone else or to learn the course material for someone else or to obtain any sort of certificate of completion for someone else aside from themselves. Our courses are meant for individual enrollment and each person who joins our course must pay for the course separately. No student is permitted to share the course material with anyone else in any way or distribute the course material to anyone else in any way while attending our courses or at any time afterwards (please refer to the “Intellectual Property” section of this document to see further explanation and clarification about the polices regarding the unauthorized use and distribution of course materials). Our school retains the right to terminate the account and course access of any student who is not abiding to our company policies (either formally written or posted, explicitly stated, implied, or reasonably expected). Our school may refuse admittance to anyone who does not adhere to our standards of professionalism, or who may not share our company’s core values (such as being respectful, showcasing integrity, being kind toward others, or other values that we feel are crucial for true success in our industry). Our school may refuse admittance to anyone who may not be seen to be compatible with our company’s expectations (educationally or otherwise), or who may not present themselves in a professionally suitable manner (including wearing appropriate attire while participating in course programs or company activities), or anyone who may not represent our company’s image or reputation in a positive way. Our school retains the right to deny service or to refuse to approve course access to anyone for any purpose aside from unlawful or discriminatory reasons (we have a very strict zero tolerance policy for allowing any sort of unlawful discrimination among our students, customers, workers, and associates throughout the company, and discrimination based on arbitrary factors such as race or gender is completely contradictory to our company’s principles). Our school reserves the right to revoke or suspend or terminate the account of anyone who is not adhering to company policies or who is not upholding our company’s standards of professionalism. A revocation or suspension or termination of an account will also revoke or suspend or terminate any credentials a student or graduate holds by our organization such as a Bartender Certificate Card (“Bar Card”) along with any other relevant materials. If a Bartender Certificate Card is revoked or suspended or terminated then the school will not verify the holder’s good standing if an outside entity inquires about their verification status. This policy will also extend to any credentials and materials the person may hold within the Twisty Bar Crew job platform. Twisty Bar School issues Bartender Certificate Cards to students who successfully complete our program and we maintain records of all Bartender Certificate Cards in our system. Keeping a Bartender Certificate Card in good standing requires holders to behave professionally and in ways representative of our company’s values, image, and reputation. If a Bartender Certificate Card holder does not meet our company’s standards of professionalism then their Bartender Certificate Card may be revoked or suspended or terminated at any time, and this person may be removed from our platform or services or systems with no compensation or refund to the holder (monetarily or in any other form). Maintaining a Bartender Certificate Card in good standing is done so on a consistent and ongoing bases, and holders may be asked to periodically provide proof of acceptable stewardship for retaining the card’s validity. The criteria for this may include being up to date and knowledgeable about bartending related subjects (such as being aware of trending cocktails, keeping up with industry information, and learning about other relevant developments within the bartending profession). Twisty Bar School holders may also be required to learn new educational material or skills in order retain the validity and good standing of their Bartender Certificate Card. This could include participating in group chats or forums, joining periodic online seminars, or following other mandatory upkeep requirements. All holders of the Bartender Certificate Card agree to adhere to the legally required alcohol safety requirements in their area, and refusing or failing to do so may result in their Bartender Certificate Card being revoked or suspended or terminated indefinitely or until all relevant legal and safety conditions are complied with.
Section 10. Length of Time Allowed to Take the Course, Course Completion Requirements, Course Participation Disclaimers, Guarantee of Outcome Waivers, Program Certificate Policies, Class Transferability, International Availability, and Adequate Testing Information:
Upon registering, students have one full calendar year to finish a purchased bartending course, and once the course videos are started they have up to 90 days to complete them (within the one year timeframe). After starting the course videos, everything in the program must be completed within 90 days. This includes the course videos, interactive mixing sessions, the TIPS Alcohol Safety Course (which has its own policies listed here below), and all other aspects of our educational program. The 90 day period can be started at any time within the one year timeframe, but if it’s started with less than 90 days left in the allocated one year period, then part of the 90 days may be lost and will not extend past the one year limit. After the one year period the student’s access to the course shall expire. Students may request an extension of the 90 day time period or the one year limit due to extenuating circumstances, but at that point our school has the discretion to decide whether or not to grant that request. If a class is purchased by someone (and it has not yet been started) then the class can be transferrable to someone else within a one year period from the date of the purchase, and if a transfer happens then the school must be notified before course videos are started so that we can update the student information in our system. Failure to notify the school of a transfer or student name change prior to course videos being started may result in the transferee forfeiting the transferred class and losing access to the program. Our class may be available to international students in locations outside of the United States, but please contact us for availability in specific countries or regions. Laws concerning bartending work and legal requirements for bartenders may differ from laws and requirements in the United States (and the certificates we offer may not be valid in foreign territories). All laws and requirements need to be followed in their local jurisdiction regardless of where an informational course is taken.
Our school requires students to watch all online course videos in their entirety while using the Student Manual, and to be present and participatory for the full online interactive mixing session, and to successfully complete mandatory alcohol safety training before graduating from our bartending class. We also require students to pass one or more tests in order to successfully complete our program. If a student, for any reason, does not pass one or more of our class’s proficiency tests (including any written, oral, performance-based, or any other type of test) then our school may give them additional attempts to retake the test(s) for no extra fee. Our current policy is to offer up to 2 retake attempts for a failed test, but this policy may be modified or updated at the discretion of our school. If during an evaluation our instructors think that a student is unable to bartend at an acceptable level or to satisfactorily perform required tasks, then our instructors have the discretion to prevent that student from passing the tests. This decision shall in no way be based on arbitrary or discriminatory factors in any way, and should only be based on the student’s performance level within standardly applicable metrics. Criteria for passing tests may be based on the amount of correct answers on a written test, or it may also include proficiency evaluations based on pouring and drink mixing ability, knowledge of recipes, serving abilities, understanding of course material, attitude, demeanor, professionalism, customer service skills, speed and efficiency, multiple drink order recollection, or any other performance or service based criteria that the school may set or require. If a student does not pass a necessary test initially and then fails again after having attempted the allocated retake opportunities, then our school may remove their program access and prevent them from receiving any type of school-issued certificate of completion. Our company is not responsible or liable for any monetary loss or other type of loss or harm suffered by the student due to them not satisfactory completing our program. Unless the school deems otherwise, refunds are not given to students who do not successfully pass tests or who fail to complete the program for another reason that’s not at fault of the school. Refunds shall not be issued (either in part or in whole) due to students not passing tests or not being able to successfully complete the course, unless the school decides a refund to be an appropriate action at that time. The vast majority of students pass the tests and do very well with the courses, but there is still a chance of not graduating due to inadequate performance. Our school does not offer a “guarantee of outcome” in any way for students, and there is no guarantee of a student graduating from our program or becoming employed or hired or experiencing any sort of reward or gain or positive result after having taken a class. The educational material we teach may be applied in different or unique ways and results may vary based on individual actions, abilities, and circumstances. Furthermore, if a student is found to be cheating on a test in any way, or collaborating with others in ways not allowed, or using test answers acquired from others, or breaking any school ethics policy (officially designated or not), or somehow manipulating the course or testing systems, or conducting any other activities that do not correspond with our school’s expressed or implied integrity principles, then that student may be denied access to our program and become immediately removed from participating in the course based on the sole discretion of our school, and with no refund or other compensation granted to them for any harm or loss suffered due to such an occurrence. We expect these cases to be somewhat rare, but please be advised that adhering to all of our company polices is necessary in order to participate in our programs and remain in our company’s bartending networks and systems and affiliated programs. Our company strictly retains a zero tolerance discrimination policy, and at no time will factors such as race, sex, religion, political affiliation, disability, or any other protected criteria or arbitrary characteristic or other personally identifying criteria be used to evaluate students within our merit-based system.
After successfully completing a bartending course, our school may issue the student a certificate of completion (or Bartender Certificate Card, which is referred to as a “Bar Card”). The Twisty Bar Card (Bartender Certificate Card) is a printable or plastic, wallet-sized certificate of completion that is issued to students once they graduate from our program. It has the graduate’s name and student number to show they have completed the course, and there is a phone number (or other contact information) on it so that employers can verify its authenticity with our school. The card can also be fit into a lanyard along with an alcohol safety certification in order to display bartender credentials. The Bar Card can be used anywhere to show the course was successfully completed and it never expires (although a certificate card may be temporarily invalidated if conditions mandate, and therefore a certificate card renewal may become necessary). Bartender Certificate Cards (“Bar Cards”) do not expire, although the school can implement a necessary renewal for previously issued certificate cards if our program significantly changes or if the school decides that certificate cards must be renewed in order to remain valid for active users. This could be due to essential new information being required, or if new skills or expertise become required, or if educational, industry, or occupational conditions regarding bartending substantially change. or for any other reason that the school determines to be sufficient. If a renewal becomes necessary then the card holder will be notified and they will be allowed to renew their certificate card so long as they attain the newly required knowledge or skills in a reasonably timely manner. Please note that that in any case, the school will not charge any sort of fee or require any sort of payment for a certificate card renewal, and a certificate card will never fully expire without the chance to renew it (and so long as the certificate card holder meets any new requirements set by the school). A bartending school certificate of completion may be required to bartend at certain establishments or in certain localities, but many places may have no requirements for obtaining such a certificate. Aside from an alcohol safety certification, many places do not require bartenders to be formally educated or carry professional credentials or collegiate degrees in order to bartend or serve alcohol. A certificate of completion from our school is not a license issued by a state or country government, yet it serves as valid proof of completing an industry-specific program with a reputable educational provider that teaches about many aspects of the profession, and its authenticity may be verified by potential employers upon request. Twisty Bar School strives to provide the best bartending education possible, so when a student completes our program it means that they have learned a great amount of material related to the occupation. We hold our certificate of completion in high regard and think it is one of the top bartender credentials available anywhere in the world. Being issued a Bartender Certificate Card (“Bar Card”) does not guarantee any sort of desired outcome though and it can not promise any kind of employment, monetary gain, access to any opportunities within the bartending industry, or ensure any sort of professional standards, work outcomes, or safety in any type of circumstance involving alcohol. A Bartender Certificate Card (“Bar Card”) that’s issued does not grant the holder any soft of special privileges or benefits or outcomes. A Bartender Certificate Card (“Bar Card”) does not replace or override an alcohol safety certification as they are different credentials that cover different educational material. A Bartender Certificate Card (“Bar Card”) does not specify if a student has learned about alcohol safety, and it does not cover a person for alcohol safety requirements or alcohol liability requirements in any area. The Bar Card is solely to show that a student has successfully completed our bartending program and is not a replacement for alcohol safety training which is separate. All students who obtain a Bartender Certificate Card (“Bar Card) must stay up to date with information such as industry developments, cocktail trends, and other relevant material in order for their certificate to remain valid and in good standing. This may include attending periodic online seminars, or participating in workshops, or passing periodic evaluations, or joining school forums, or providing the school with up to date workplace or occupational or career information, or adhering to any other mandatory requirements the school may set. If at any point a Bartender Certificate Card (“Bar Card”) holder is shown to not uphold our company’s policies, or if they act improperly or disrespectfully, or bartend unsafely or irresponsibly, or behave in a way that does not meet our company’s standards, then their certificate may be revoked and deemed invalid at the sole discretion of our school. Revoking a certificate may also remove their access to other elements of our program or service offerings. If a revocation or suspension or termination of a certificate occurs then the holder of the certificate shall not be compensated in any way (monetarily or otherwise) for any loss or harm or suffering due to the situation. Anyone actively utilizing a certificate from our school is representing our company, so we must ensure that all parties uphold our standards of responsibility, excellence, and professional conduct at all times.
Alcohol Safety Training and The TIPS Program: Students must understand the alcohol safety certification requirements in any area where they work and fully adhere to those requirements. This may include passing alcohol safety examinations, or holding any necessary certifications, documentation, permissions, credentials, or licenses, along with maintaining, updating, and renewing any certification when needed or required by law. Understanding alcohol safety is essential for serving alcohol, and safety laws and regulations should always be followed. Twisty Bar School strongly emphasizes alcohol safety throughout our courses, but our company is not responsible for a current or former student’s alcohol safety certification becoming invalid, expired, lost, or unusable in any way. It is the sole responsibility of any individual who is required to hold an alcohol safety certification, to uphold and maintain that certification in order to bartend or handle alcohol wherever they are located. If a student wants to bartend outside of the location where their alcohol safety certification was issued, then they are responsible for understanding the alcohol safety training requirements in that other location and must obtain any other location-based alcohol safety training certifications or credentials required there. Some alcohol safety training certifications are invalid outside of the jurisdiction where they are issued, so all people bartending or handling alcohol must be aware of this. Twisty Bar School tries to provide each student with the alcohol safety training that is best for their area, but we may not always be correct with which alcohol safety training to offer in all instances (and we may not fully understand all applicable laws in all places at all times), so it is up to the individual student to be sure that they are adhering to all local laws and that they are obtaining all required alcohol safety training certifications or credentials needed in their local area or in any other area where they bartend. This is especially relevant if a student bartends in an area outside of the one from where they initially take their alcohol safety training course. Laws vary by region and different states and jurisdictions sometimes have their own alcohol safety laws which require alcohol handlers or bartenders to be trained in a location-specific program or go through other mandatory location-based procedures. Twisty Bar School strongly encourages all bartenders to check their local laws and to follow all necessary guidelines and regulations that pertain to bartending or alcohol service. Please mix responsibly at all times. There are timeframes to complete alcohol safety training courses. Once the TIPS Alcohol Safety is issued to a student, that person has 30 days to complete the TIPS online course before their access to it expires (which is mandated by TIPS as part of their training policy). When a student is issued an alcohol safety course such as TIPS then they must agree to the terms and conditions of the alcohol safety training company. Students must understand that if they fail a TIPS test, then they may only get one free retake attempt before having to to pay an additional fee in order to retake their course (which may be a full repayment for a new TIPS course). If a student does not pass an alcohol safety test after the predesignated amount of allowed retake attempts, then they are not entitled to any sort of compensation or refund in any way (monetarily or otherwise). In most states we provide our students with the standard TIPS Alcohol Safety Course, which covers them in many areas nationwide for alcohol safety training (although it may not be accepted in some areas due to local or state-specific alcohol safety requirements). In certain states we offer students a state-specific TIPS Alcohol Safety Course if their state requires such training. This sometimes occurs because a state may want their bartenders to be informed about unique rules and regulations in their own state, or they may have unique educational criteria required to be explained. In any case, if a student takes a TIPS Alcohol Safety Course in a state that has their own state-specific program, then the TIPS Certification received may or may not be valid in other areas or other states depending on the laws (and the same goes for the standard TIPS Certification possibly not being accepted in states or jurisdictions that have their own local requirements). Students can determine which TIPS Alcohol Safety Course will be best for them, and in a rare case where TIPS Alcohol Safety Training is not accepted at all in their location, we will work to find another provider or alternative options in order to be sure the student gets covered for alcohol safety education. Completing alcohol safety training is required in order to finish our bartending program (unless the student can show proof of having already successfully finished sufficient alcohol safety training that is valid, has not yet expired, and will not expire for at least two years from the date which they complete the program). The standard TIPS Alcohol Safety Certification is generally valid for 3 years, but some states have set their own expiration dates that typically run from 2 - 4 years, but other possible timeframes may exist.
Most students have few issues with passing our bartending course tests and successfully completing the program. If a student pays close attention to the course material and puts forth a strong effort to learn, then statistical chances are that they will most likely pass (yet to be clear, there is no guarantee whatsoever of this preferred outcome). Our school tries its best to ensure that each student does as exceptionally as possible when enrolled, and students are always supported by our team throughout their enrollment in our courses.
Section 11. Bartending Work and the Twisty Bar Crew Job Platform (Including Bartender Performance Expectations, Professional Conduct Standards, Alcohol Responsibility Guidelines, and Job Placement Assistance):
The Twisty Bar Crew is a job platform that we offer to our students so they can connect with bars and events that need bartenders to work. Bartenders on the platform can create profiles to showcase their skills to potential employers, which can assist them with becoming hired. This service is provided in addition to our educational courses, and it is a separate program that has its own criteria which students must meet in order to be allowed onto the platform. At any point a user’s access to the platform may be refused or revoked if they do not meet the criteria set by our company. All bartenders on the Twisty Bar Crew platform must adhere to our professional standards at all times. Each bartender on our platform is subject to a periodic evaluation of skills and abilities to ensure that a high level of standards are met. This may include bartenders on the platform being performance tested from time to time. It is important to be sure that bartenders keep up with industry developments and remain aware of cocktail trends and show competency among other professional metrics. Bartenders on the platform may be asked to attend periodic educational seminars or join company forums, or show an active status of usage by participating in workshops or events, or be asked to engage in other participatory activities that our company deems relevant. Our school seeks to provide bars and events with bartenders who have been properly trained and who can perform exceptional work. All bartenders utilizing the platform must acknowledge that they are acting independently when engaging with the bars or events seeking to hire them, and that they are not employees or contractors for our company. Therefore the bartenders on our platform are not entitled to employee benefits and do not have any authority to bind or represent the company. Unless stated otherwise, no monies are earned or exchanged by our company when a bartender on our platform is hired or booked by a client. Our company does not benefit monetarily or profit from bookings, or charge any rates or percentages to any involved party, and we are not bound by a contractural relationship with the bartenders presented on the site. We offer this platform to our graduates as a beneficial service to help them with their bartending endeavors, but not as a means to monetize from their occupational services. If at some point our company hires bartenders as employees or engages in contractual agreements with independent contractors, then the relationship between the Twisty Bar Crew platform and its bartenders may change, requiring an altered and updated terms of service. All user data collected by our platform is strictly used for the purposes of our company and not shared with anyone for any reasons that are not conducive to our company’s operations. Bartenders using this platform agree not to collect client data or to take photos or videos of clients during work. It is always essential to provide clients with confidentiality and discretion. Bartenders agree not to not contact or spam clients with messages, texts, phone calls, mailings, social media interactions, emails, in-person greetings, or any other sort of correspondence or exchange, and to not solicit clients for any professional services unrelated to bartending during events or while working as a bartender (or at any time afterwards). Bartenders using this platform agree to keep all client information fully confidential and never share, sell, offer, or otherwise distribute any client information for any reason. Bartenders using this platform also agree to keep our company’s proprietary information and business methods confidential and to not share our trade secrets, methods of operation, or any other business practices with anyone outside of our organization.
Bartenders on our platform are required to hold all of the necessary alcohol safety certifications, work permits, required alcohol liability insurance coverage, along with any other professional credentials in order to use our services. This includes bartenders to comply with all applicable laws governing their occupation in their area. All bartender records such as the bartender certificate card, alcohol safety certification, alcohol liability insurance, and any other work related credentials must be up to date and on file with our company so that we can easily access them and present them to guests or any authorities who may need to verify their good standing. All bartenders are responsible for renewing or updating their alcohol safety certifications and insurance coverage plans, so that these things remain in good standing and are legally valid wherever the person is working. Bartenders on the platform may be asked to undergo background checks to ensure they are of acceptable character and not involved in serious crimes. In many locations, bartenders are not allowed to sell alcohol or distribute alcohol on behalf of their employer outside of their workplace. In many cases bartenders also cannot transport alcohol at any time for any reason (this includes when traveling to their shifts as well as traveling away from their shifts). Bartenders are not allowed to supply alcohol to bars or events without the proper license. Bartenders must never consume any alcohol at any time while working, or at any time throughout the day before a shift starts. Our platform has a zero tolerance policy for bartenders consuming alcohol or becoming intoxicated in any way while working, and any bartender found to be intoxicated during a shift, will have their access to our platform removed. All bartender profile and account material such as photos, videos, posts, and messages are subject to our company’s approval, and any inappropriate content will be removed without notice and without any sort of compensation from doing so. All messages, posts, images, videos, calls, and other content and communications on our platform are monitored, sometimes reviewed, and may be used for commercial, marketing, promotional, research, or quality control purposes by our company. All users’ communications (including communications to and from bartenders and clients) within the Twisty Bar Crew platform may be reviewed for quality control, security measures, or other internal or external purposes by our company. By agreeing to these terms and conditions you give Twisty Bar School and Twisty Bar Crew the permission to use your likeness (in the context of working as a bartender) for promotional, marketing, or other educational or commercial purposes, and you consent to the conditions listed herein. At times bartenders may be subject to having photos or videos or audio recordings taken of them while working at events or bars, due to clients or affiliates or partners or workers or contractors or service professionals potentially photographing or recording them for said purposes. You agree to allow for our company, or for any of the parties mentioned herein, to use your likeness and image (in the context of working as a bartender) in any post-event content or media production such as a photo or video compilation, or for use to promote future events, or for other commercial or business-related reasons. If you do not consent to this usage, then at any time you may opt-out of having your likeness or image used for any purpose by providing our school with a written and notarized request.
The Twisty Bar Crew platform reserves the right to terminate or suspend a user’s account or bartender’s account if they do not adhere to our company’s rules of professional conduct. All bartenders must follow the Bartender Guidelines that are agreed upon before they begin work. This includes following rules of conduct, adhering to professional standards, using ethical business practices, and consenting to other integral company policies. It is essential for bartenders to serve alcohol in the safest and most responsible manner possible. This means to practice responsible serving techniques such as never serving customers too much alcohol, to refuse alcohol service to anyone who is seemingly intoxicated, to monitor the alcohol consumption of guests, to check identification in order to verify age requirements for alcohol service, to offer non-alcoholic drink options to guests who may benefit for safety reasons, to ask for a manager’s help if necessary in challenging situations, to document important alcohol related incidents, and to measure the amounts of alcohol being poured when serving guests (and to never serve over the legal limit of alcohol allowed per drink). If a bartender shows severe incompetency or unprofessionalism in any way, then our company reserves the right to remove that bartender from our platform without any type of compensation for any harm or loss caused by their removal (including the loss of future work which may lead to the forfeiture of revenue from upcoming jobs already booked on the platform). This is regardless if the bartender has completed educational training, bought supplies, purchased alcohol liability insurance, booked future travel, reserved venue space, or anything else. Bartenders on the Twisty Bar Crew platform are responsible for their own legal documentation and taxation requirements, and they must report and handle their own government filings and manage all necessary legal paperwork on their own. This includes completing or administering any sort of legal obligations such as filing taxes, submitting forms or applications, requesting permits or licenses, complying with mandatory regulations, or any other type of legal or compliance issue. We may potentially help in some ways in relation to which paperwork or forms may be appropriate to use for a given circumstance, but we are not responsible for the governmental filings or legal requirements of bartenders, and any of our assistance in this regard is not to be taken as legal advice or financial advice or any other type of professional advice. Our company is not responsible for loss of profit or other harm caused by incorrect or improper filings with government agencies, or noncompliance with applicable laws, or failure to accurately report earnings, or an insufficient understanding of legal requirements, or inaccurate or incomplete form submissions, among other corresponding issues.
We try to connect graduates with clients in hopes that they form mutually beneficial working relationships, but if a situation does not work out for some reason, or if a negative interaction arises, then we will do our best to help internally remedy the issue. If a bartender and client have a dispute with each other on the platform, or if there is a dispute between multiple users on the platform, then the issue lies only between the involved parties, and our platform is removed from the conflict (unless we have a pertinent role in the substance of the conflict). Our platform acts as solely as a facilitator and does not assume responsibility for any disputes or damages or losses or outcomes arising between users. Twisty Bar School is not liable for any situations that may occur beyond our reasonable control, including conflicts or disputes or interactions among users of the platform who are acting independently and outside of our company’s direct oversight. In the case of a dispute occurring, users agree to first try to resolve the issue through an internal mediation process, or if necessary, binding arbitration as a last option, rather than a court of law. During our company’s internal dispute resolution process, each party agrees put forth a genuine good faith effort to attempt coming to reasonable solution. Then if any affected party does not agree upon a decision made by our internal resolution process, the issue may elevate to arbitration, which is binding, final, and cannot be changed on appeal. This shall be a neutral arbitrator chosen by our company and held in the state or jurisdiction where our company is based, or a mutually agreed upon location that our company chooses. The detailed process regarding our internal resolution and for pursuing arbitration (along with the rules that govern these processes) may be found in the platform’s user contracts. As stated, the last recourse for any dispute among users of our platform is binding arbitration, and all users of our platform waive their rights to bring any claims to a court of law or to receive a trial by jury (except for cases concerning intellectual property issues, or copyright infringement matters, or the misappropriation of trade secrets or the misappropriation of confidential information, or violations of our non-compete clause, or in situations calling for emergency injunctive relief). All users of the Twisty Bar Crew platform and purchasers of our services agree to not implicate Twisty Bar School or attempt to hold Twisty Bar School liable for situations beyond our reasonable control.
By accepting these terms of service you agree to use the Twisty Bar Crew platform at your own risk and your only remedies for relief are listed in our internal resolution process and arbitration guidelines set herein. All users of the Twisty Bar Crew platform agree to waive all rights to a jury trial and to not participate in any sort of class action lawsuit, representative or collective action, private attorney general action, or any other representative proceeding involving our company. You agree that any disputes or claims shall be brought solely on an individual basis. Please be aware that our company tries our best to create a platform where bartenders can connect with clients for mutual benefit, but there is no guarantee of outcome with using the platform and we do not in any way guarantee any user of our platform to receive any type of monetary gain or hiring opportunities or job placement or bartending employment or skill development or networking gains or professional advancement. The Twisty Bar Crew platform must be used at its own risk. Twisty Bar School hereby disclaims all liability for actions taken by users of our platform that are outside of our reasonable control. This includes, but is not limited to, a bartender serving alcohol irresponsibly, a bartender causing a situation that results in harm or damages, a bartender not behaving appropriately in any way, a bartender making unwise or unsafe decisions, a bartender or client causing someone any kind of loss or harm or suffering, a dangerous situation that results in any sort of physical or mental harm, an accidental problem that causes distress, a misuse of work tools or venue facilities, a bartender losing or missing work due to unforeseen or unusual or undesired circumstances, a client underpaying a bartender, a client mistreating a bartender, any miscommunication between clients and bartenders, any loss or harm or suffering experienced from a bartender and client interaction (or interactions among any set of users on our platform), or any other sort of negative situation that may arise without direct involvement or immediate oversight from our company. Alcohol can be a dangerous substance and consuming it can lead to dangerous consequences. Our company cannot guarantee that every circumstance concerning alcohol will be safe, and all users of the platform agree to use our services at their own risk and without expectation of positive outcomes or guaranteed safety in all instances. TWISTY BAR SCHOOL STRONGLY ENCOURAGES ALL BARTENDERS TO HANDLE ALCOHOL AS SAFELY AND RESPONSIBLY AS POSSIBLE, THOUGH WE ARE IN NO WAY LIABLE FOR THE ACTIONS TAKEN BY INDEPENDENT BARTENDERS WHO MAY BE UTILIZING OUR NEUTRAL PLATFORM, BUT ARE ULTIMATELY ACTING ON THEIR OWN BEHALF AND ARE RESPONSIBLE FOR THEIR OWN INDIVIDUAL ACTIONS.

Section 12. Severability and Updates to our Terms of Service:
These terms constitute the entire agreement between you and Twisty Bar School. Each clause and provision in these terms of service is separately enforceable. If any part or parts of these terms of service are found to be invalid or unenforceable under applicable law, then such specific part or parts shall be severed and not utilized. Yet the remainder of the terms of service shall survive and continue in full force and effect while remaining binding and enforceable. The terms listed in this document override and supersede any prior terms of service, statements, communications, agreements, or conditions brought by our company. In the event that certain polices herein differ from the policies listed in previous versions of our company’s terms of service or contractual arrangements, the most recently published version shall prevail. Our school may periodically notify customers or clients of updated terms of service conditions, and we encourage all parties to check the most current terms of service if they encounter an issue or would like to understand any relevant changes that may have been enacted since their last reading of the information listed within this document. The polices herein comprise our terms of service, but legal compliance adjustments may be enacted in certain jurisdictions where enforceable, dependent on local regulations and applicable laws.
